Wants copyright permission

Question

July 27, 2010

I teach Grammar and Composition at the Classical School of Wichita in Wichita, Kansas, where a colleague, Amy Alexander, and I are writing a composition book which will focus on the elements of the classical progymnasmata for students in the seventh and eighth grades at our school. We may seek wider publication eventually, but during the school year 2010-11, we plan to reproduce and use the materials in-house and only at our school.

We seek permission to include your essay “Lyrics of Song ‘School Days’ Represent Teen Attitudes,” which is located on your web site, School for Champions. It would be used in the chapter on paragraph development and attribution would be given in a bibliography at the end of the work. If you like, I will be happy to send a copy of my current draft of the section for your perusal.

Could you tell us what process we would need to follow to receive permission?

Answer

The use of song lyrics as part of an educational lesson is considered "fair use" in copyright law. Permission of the copyright holder is usually not necessary, although it is good practice to give credit to the copyright holder.
The main issue in fair use of a copyright is that it is not for profit but instead for educational purposes. Using a section of the lyrics fits into this classification. However, putting the lyrics into a book that is used in school or may be sold may require permission from the copyright holder.

It is a complex issue. For information on fair use copyright, see:

Feel free to use my essay in your book. Educating the students is what it is all about.

Best wishes in your class.
